Narinderpal Singh vs State of Punjab

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

Narinderpal Singh was convicted under Section 302 IPC for the murder of Gobind Singh at Rajindra College. The prosecution relied on witnesses who claimed to see him holding a blood-stained kirch after the incident. The Supreme Court reversed the conviction, finding that there was no reliable eye-witness to the actual assault. The trial court's reliance on one witness was rejected by the High Court as planted evidence. The only remaining witness testimony was indirect and circumstantial. The Court held that possession of a weapon alone cannot prove guilt without credible direct evidence, and the prosecution failed to establish guilt beyond reasonable doubt. The appellant was acquitted of all charges.
