Sahib Singh was convicted by the Trial Court and the High Court under Section 326 IPC for assaulting a deceased person (Harbans Singh) with a kirpan. Singh's main contention was that he was not named in the original FIR. The Supreme Court upheld the convictions, noting that eyewitness testimony from the injured complainant and another injured witness clearly identified Singh's presence, possession of the weapon, and the assault. The Court found that concurrent findings by both lower courts on matters of fact merited no interference. Singh's appeal was dismissed."
