Narmada Bachao Andolan vs Union of India and others

Bench: 3 — Jagdish Singh Khehar

In Brief

This case concerns the rehabilitation of over 4,990 project-affected families displaced by the Sardar Sarovar Project in Madhya Pradesh. The Supreme Court found that 681 families had not received any compensation, while 1,358 families who received cash payments were duped by middlemen and could not purchase promised land due to official negligence and corruption. The Court ordered Rs. 60 lakhs per family for the 681 uncompensated families and Rs. 15 lakhs additional per family for the 1,358 duped families (as final settlement). All families must vacate the submergence area by 31 July 2017. The Court also established a Grievance Redressal Authority to address claims for amenities promised under the 1979 Tribunal Award, with appeal rights to courts."
