In Brief
The Surat Municipal Corporation appealed against directions regarding compensation and rehabilitation for land acquired to build a Sewage Treatment Plant. The landowner sought rehabilitation through allotment of a residential plot rather than monetary compensation. The Supreme Court held that where a landowner's primary interest is rehabilitation, an appropriate residential plot may be allotted before any scheme allotments are made, in lieu of monetary compensation. The Court noted this decision was based on the peculiar facts of the case and did not assess the adequacy of compensation already computed. The appeal was disposed of accordingly.
