Dr. Narottam Mishra challenged an Election Commission of India order dated 23 June 2017 that affected his status as a Madhya Pradesh MLA and voting eligibility in a presidential election scheduled for 17 July 2017. A rival transfer petition also arose. The Supreme Court directed the writ petition be transferred from the Madhya Pradesh High Court to the Delhi High Court and requested expedited hearing and interim relief consideration by 13 July 2017. The Court emphasized that his membership status could only be finally determined after the High Court addressed the substantive challenge to the Election Commission's order.
