National Highways Authority of India challenged a Delhi High Court order that had substantially set aside an arbitral award for drawing incorrect inferences and failing to consider vital evidence. Both parties subsequently agreed to a fresh arbitration. The Supreme Court allowed the appeal and directed that fresh arbitral proceedings be conducted by the Indian Council of Arbitration with Justice G. S. Singhvi (retired Supreme Court judge) as the Sole Arbitrator. The arbitrator must comply with independence and impartiality requirements and complete proceedings within 12 months. The Delhi High Court's interim order was set aside.
