The accident occurred when the deceased, driving a Maruti car, was hit by an Eicher van that turned right without signalling. The trial tribunal found both drivers partly negligent, awarding Rs.10,40,500/-. The High Court reversed this, finding the van driver solely negligent, and awarded Rs.1,85,08,832/- based on the deceased's established annual income and standard multipliers. The Supreme Court dismissed the insurer's appeal, holding that eyewitness testimony recorded in court outweighs the initial police report, and the compensation was properly calculated according to settled legal principles.
