The National Investigation Agency (NIA) appealed against a High Court of Delhi order relating to bail in a case against Gautam Navlakha under the Unlawful Activities (Prevention) Act. The Supreme Court had previously directed the accused to apply before the Bombay courts within one week. The accused instead filed an application before the High Court of Delhi. The Supreme Court held that once it specifies a jurisdictional forum, that court alone has authority to hear such applications. The Delhi High Court lacked jurisdiction and should not have entertained the application. The appeal was allowed, the High Court's order was set aside, and the accused was directed to apply before the competent Bombay court.
