Nazrul Islam, a retired All India Services officer, challenged a High Court judgment upholding the continuation of disciplinary proceedings against him after his retirement. The Supreme Court held that while Rule 6(1) of the All India Services (Death-cum-Retirement Benefits) Rules, 1958 permits disciplinary proceedings to continue post-retirement to withhold pension or order recovery, such action is only permissible if the officer is found guilty of grave misconduct. The Court directed the Central Government to give him a hearing before passing final orders and to conclude proceedings within six months, or they would be deemed dropped. The appeal was disposed of accordingly.
