A bank manager challenged his compulsory retirement imposed in disciplinary proceedings. He argued the show cause notice was issued before receiving the enquiry report, that reasons were not recorded, and the punishment was disproportionate. The High Court had affirmed the dismissal of his appeal but directed payment of retiral benefits. The Supreme Court upheld the dismissal, holding that the disciplinary authority properly enclosed the enquiry report with the show cause notice, that separate detailed reasons are not required when accepting the Enquiry Officer's findings, and that compulsory retirement for serious loan disbursement misconduct was proportionate. Service benefits must, however, be paid.
