The Supreme Court addressed the termination of Panchayat primary teachers in Bihar who failed evaluation tests. The teachers were appointed under the 2006 Rules when the evaluation test was intended only for increments. Following the Right to Education Act 2009, the State amended rules requiring trained teachers and made evaluation tests compulsory. The Court held that adequate training in recognized institutes is essential before subjecting teachers to evaluation. Teachers who fail for a third time must receive six months of training followed by re-evaluation with minimum marks. Failure to complete training may result in removal from service.
