Panchayat primary teachers in Bihar sought to be removed from service for failing evaluation tests challenged the legality of termination. The Court held that while the original 2006 Rules intended evaluation only for increments, the Right to Education Act 2009 changed education requirements. Teachers must receive adequate training before teaching. The Court directed the State to provide six-month training to teachers failing evaluation tests thrice, followed by a re-evaluation with minimum marks. Failure to complete training may result in removal. Appeals disposed.
