Nisha Singla, a founder member of Adarsh Colony Cooperative House Building Society since 1975, was allotted a 250 sq. yards residential plot but never received physical possession. Despite her repeated attempts through various administrative and judicial forums over 40 years, her claim was dismissed on technical grounds. The Supreme Court set aside the previous dismissals, holding that a substantive right to an allotted plot cannot be defeated by procedural non-grievance. Invoking Article 142, the Court directed the Registrar of Cooperative Societies to verify the allotment and deliver possession within four months, or allot a suitable alternative plot if the original was unavailable.
