A tenant in a rent control dispute challenged the High Court's rejection of his applications for extension of time and condonation of delay in depositing arrears of rent and mesne profits. Although the tenant missed the High Court's initial deadline (31.12.2017), he had subsequently deposited Rs.96,997/- in execution proceedings (accepted by the landlady) and a further Rs.33,000/- directly to the landlady. The Supreme Court found the High Court's dismissal orders were passed without considering these material facts and without noting that the High Court's own 2017 order had superseded the original tribunal decrees. The Court allowed the appeals, set aside the High Court's orders, and directed the tenant be restored to possession, allowing him to continue paying monthly rent as per the High Court's terms.
