A tenant in Rajasthan challenged the High Court's rejection of applications for extension of time and condonation of delay in depositing rent arrears. The tenant had deposited Rs. 96,997 in execution proceedings and Rs. 33,000 directly to the landlord's bank account. The Court held that the High Court's orders were passed without considering these material deposits already made. Since the deposits satisfied the High Court's 01.11.2017 order (which superseded earlier tribunal orders), and the landlord had accepted the amounts, the Court set aside the High Court's dismissals, allowing the appeals and restoring the tenant's possession of the premises.
