The Supreme Court dismissed an appeal under Section 125 of the Electricity Act, 2003 filed 71 days late. The Court held that the statutory outer limit of 120 days (60 days initial + 60 days condonable) for filing appeals from the tribunal cannot be extended, even using Section 5 of the Limitation Act or Article 142 of the Constitution. The 120-day limit is a mandatory statutory command based on public policy and is equivalent to absolute limitation. Time spent pursuing a review petition cannot justify extending this outer limit. The appeal must be dismissed without addressing its merits because it exceeded the statutorily prescribed deadline.
