Okhla Enclave Plot Holders’ Welfare Association vs Union of India and Others

Bench: 2 — Sanjay Kumar, Ravindra Bhat

In Brief

A writ petition by plot allottees against a colonizer and the state authority concerning undeveloped plots in Okhla Enclave. The dispute arose when the original colonizer holding seven licences did not develop the area or allot plots, and a successor company (Durga Builders Pvt. Ltd.) claimed succession to only two licences. The Court held that allottees who purchased in good faith are entitled to their plots; the successor must first pay outstanding licence fees and development costs before claiming surplus plots. Non-compliant allottees must pay arrears with 6% interest or forfeit rights. The Court clarified that the proceedings are a special committee, not formal arbitration.
