A landlord filed for eviction of a tenant to demolish and reconstruct a building. The tenant offered to vacate if reinstated in equivalent space afterwards. The landlord's counsel unequivocally agreed before the High Court to re-induct the tenant within one month of construction completion. The landlord later denied authorizing this statement and sought to retract it. The Supreme Court held that the landlord is bound by his counsel's unequivocal commitment made in the course of the proceeding's subject matter. Since the exact area could not be provided due to building structure constraints, the Court directed a modified arrangement with compensatory damages of Rs. 74,000 for the reduced area, partly allowing the appeals."
