The appellant sought suspension of his sentence pending a criminal appeal before the High Court. The co-accused in the same case had been granted suspension of their sentences, but the appellant's request was declined. The Supreme Court held that parity required the appellant's sentence also be suspended during the pendency of the criminal appeal. The appeal was disposed of by directing the appellant's release on bail subject to depositing the fine and furnishing a personal bond of Rs. 50,000 with two sureties.
