ONGC LABOUR UNION vs ONGC DEHRADUN

In Brief

The ONGC Labour Union challenged a High Court decision quashing a 1994 government notification that prohibited contract labour employment in ONGC establishments. The Supreme Court held that the labour union, whose members were directly affected by the notification, should have been impleaded in the original writ petition. Because the union was denied representation and the High Court lacked relevant materials on the sub-committee study preceding the notification, the Court remitted the case to the High Court for fresh consideration. All relevant labour unions must now be impleaded and heard in accordance with principles of natural justice.
