Oriental Insurance Company Limited vs J.K. Cement Works

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

Oriental Insurance Company Limited appealed against a National Consumer Disputes Redressal Commission order directing it to compensate J.K. Cement Works for coal loss. Heavy rainfall and resulting flood-like conditions in the insured premises had caused coal to be washed off. The insurer's own surveyor had documented the heavy rainfall and water accumulation. The Supreme Court upheld the NCDRC's finding, holding the NCDRC's conclusion was not erroneous and was consistently reasoned. The Court dismissed the appeal and directed the insurer to pay the awarded compensation within eight weeks."
