The appellant-husband challenged the High Court of Bombay's order transferring a divorce petition filed before a subordinate court in Tamil Nadu to a Family Court in Maharashtra. The Supreme Court held that under Section 25 of the CPC, 1908, the power to transfer cases between different High Courts and their subordinate courts rests exclusively with the Supreme Court, not with individual High Courts. The Bombay High Court therefore lacked jurisdiction to entertain the transfer application. The appeal was allowed and the impugned order set aside.
