In this appeal, the husband challenged the Bombay High Court's decision to entertain his wife's application to transfer their divorce proceedings from a Tamil Nadu subordinate court to Maharashtra. The Supreme Court held that the power to transfer cases between states or between different High Court jurisdictions is exclusively vested in the Supreme Court under Section 25 of the Code of Civil Procedure, not in individual High Courts. The Bombay High Court therefore lacked jurisdiction to entertain the transfer petition. The Court allowed the appeal and set aside the High Court's order.
