The appellant, an LDCE-promoted Charge-man Grade-II (Electrical), was placed senior to respondent No. 4 in the seniority list, as per the statutory quota-rota rule which mandated that LDCE promotees rank above direct recruits. Respondent No. 4, initially appointed as a direct recruit in April 2000, had also been selected for promotion under the LDCE quota but declined it. He later sought to be placed above the appellant, arguing the department had failed to inform him of the seniority rule. The CAT and High Court allowed his plea. The Supreme Court reversed this, holding that statutory seniority rules must be followed irrespective of employee ignorance, and the department had no obligation to advise employees about existing rules.
