The respondent had applied under an ex-casual labourers recruitment policy but was rejected multiple times. The High Court found that candidates with fewer years of service but placed lower in the seniority list had been appointed. The Supreme Court affirmed that the list was a valid seniority list and held the respondent must be reconsidered on par with appointed candidates of lower seniority. The Court rejected the company's contention that the list was merely an eligibility roster, but permitted examination of other substantive issues like certificate authenticity during reconsideration. The appellant was directed to decide within six weeks.
