In this case, a no-confidence motion against a Gaon Panchayat President was passed by nine out of ten members. The President challenged the motion's validity on the ground that the Block Development Officer, not the Deputy Commissioner, convened and presided over the meeting, in breach of Section 15(1) of the Assam Panchayat Act, 1994. The High Court and Division Bench quashed the resolution as invalid due to this procedural defect. The Supreme Court allowed the appeal, holding that although the procedural requirement was mandatory, the President's participation in the meeting with full knowledge constituted a waiver of the mandatory condition. The resolution was upheld as valid.
