A retired government official obtained possession of a plot allotted by Haryana Urban Development Authority (HUDA) and constructed a building after the District Consumer Forum overturned HUDA's refusal to deliver possession. However, the State Commission later set aside the District Forum's order, holding the appellant no longer a consumer having accepted refund. Yet during these pending proceedings, HUDA officials irregularly issued possession, regularisation, and completion certificates. The Supreme Court allowed the appeal and permitted the appellant to retain the plot subject to payment at the current prevailing HUDA rate of Rs. 10,500 per sq. metre, recognizing his substantial good-faith investment and construction, while directing accountability proceedings against erring officials.
