City and Industrial Development Corporation of Maharashtra sought to withhold a No Dues Certificate from Lambda Therapeutic Research Ltd., which had purchased a constructed property built on land allotted to the corporation. Although no direct contract existed between them, the purchasers sought the certificate via writ petition. The Supreme Court held that while the corporation could verify construction completion through its own investigation, courts cannot judicially decide factual disputes about completion dates. The appeal was partly allowed, permitting the corporation to withdraw the provisional certificate and conduct proper verification before final decision, while preserving purchasers' right to deposit disputed amounts and pursue inter-se remedies.
