Parshotam Lal & Anr vs State of Punjab & Ors

Bench: 2 — Kurian

In Brief

The Supreme Court considered appeals challenging the discretionary forfeiture percentages imposed when the appellants surrendered plots. The Court found that while no uniform forfeiture standard can apply across all cases due to varying factual circumstances, the interests of justice warranted extending similar treatment to the appellants as had been granted to comparably situated parties in a reference case (Annexure P6). The Court reduced the appellants' forfeiture percentage to 2%, noting this relief was based on the peculiar facts and should not be treated as precedent.
