Supreme Court of India 2016-01-19 dismissed

Parveen vs State of Haryana

Bench: 2 — Uday Umesh Lalit

In Brief

Parveen was convicted along with Jaswant for attempting to commit robbery while armed with deadly weapons (knife and iron rod) under IPC Sections 398 and 401, and for possessing a stolen vehicle. The Trial Court imposed seven years rigorous imprisonment, the statutory minimum under Section 398. On appeal, the petitioner sought sentence reduction citing time already spent in custody. The Supreme Court dismissed the appeal, holding that the seven-year minimum sentence under Section 398 IPC is mandatory and cannot be reduced. The Court affirmed the conviction as the evidence clearly showed the accused armed with weapons attempting to stop vehicles for looting, with no lawful explanation for possessing a stolen car.
