Rakesh & Anr vs State of Haryana

Bench: 2 — Banumathi

In Brief

Rakesh and Dalbir appealed against their conviction for attempt to murder under Section 307 IPC and unauthorized possession of firearm under the Arms Act, 1959. They argued that a medical opinion suggested one injury could have been from a blunt weapon, not a firearm. The Supreme Court upheld the conviction, finding the injured witness's testimony credible and consistent with the nature of injuries. However, considering that the accused were only 24-26 years old at the time of the 2000 offence, the Court reduced their sentence from seven to five years imprisonment.
