PATEL ENGINEERING LTD vs NORTH EASTERN ELECTRIC POWER CORPORATION LTD. (NEEPCO)

Bench: 3 — R. Banumathi, Indu Malhotra, Aniruddha Bose

In Brief

Patel Engineering challenged the High Court's dismissal of review petitions against a judgment that had set aside three arbitral awards in a dispute with NEEPCO over transportation rates. The Court held that review petitions cannot be entertained after dismissal of Special Leave Petitions challenging the substantive judgment, without obtaining liberty at the time of dismissal. The Court also found that the High Court correctly applied the law of patent illegality, holding that an arbitral award can be set aside where the arbitrator's contract interpretation is so perverse that no reasonable person could accept it. The SPetitions were dismissed.
