This appeal concerned the enhancement of compensation for land acquired by the National Highways Authority of India. The Supreme Court held that compensation must be calculated exclusively on the basis of returns from fruit-bearing trees, as determined by the Reference Court, rather than general land value. Appellants are entitled to additional compensation, solatium, and interest under Section 28 of the Land Acquisition Act, 1894. Any previously received compensation based on land value must be adjusted against the revised award with 15% interest from the date of receipt, unless the final compensation award has been deposited in court.
