In Brief
The Supreme Court considered appeals regarding enhancement of compensation for land acquired under the Land Acquisition Act. The appellants, whose land including fruit-bearing trees was acquired for a national highway project, sought enhancement of compensation. The Court held that compensation should be calculated based on the return from the fruit-bearing trees as assessed by the Reference Court. The appellants were entitled to additional compensation, solatium, and interest under Section 28 of the Act. Previously received compensation based on land value would be adjusted with 15% interest from the date of receipt, unless deposited in court.
