Peneet Isaac vs Lakshmanan & Anr

Bench: 1 — <UNKNOWN>

In Brief

A 19-year-old motorcyclist was struck by a negligently driven bus, sustaining serious injuries. The Motor Accident Claims Tribunal awarded Rs. 69,000 compensation, accepting a 25% disability despite medical evidence of 51%. On appeal, the Court held that the Tribunal's reduction was unjustified and awards under several heads were inadequate. Applying 51% disability at Rs. 2,000 per 1%, plus enhanced awards for pain and suffering, loss of income, transport, and nutrition, the Court enhanced total compensation to Rs. 1,33,000 (an additional Rs. 64,000), directing the insurance company to pay the difference with interest within four weeks."
