Pharmacy Council of India vs S.K. Toshniwal Educational Trusts Vidarbha Institute of Pharmacy and Ors. etc

Bench: 3 — <UNKNOWN>

In Brief

The Supreme Court resolved a jurisdictional dispute between the Pharmacy Council of India (PCI) and the All India Council of Technical Education (AICTE) over regulation of pharmacy education. The Court held that the PCI, as the statutory body composed of pharmacy experts, has exclusive authority over pharmacy education, including approval of courses, recognition of degrees and diplomas, and student intake capacity decisions under the Pharmacy Act, 1948. The AICTE Act does not apply to pharmacy. Institutions that increased intake as approved by AICTE without PCI approval were directed to reapply to PCI within four weeks. This decision eliminated dual regulation in pharmacy education.
