Shirpur Education Society sought approval to admit pharmacy students beyond its approved intake capacity of 180 students, requesting an additional 60 places in an evening shift. The central issue involved a regulatory conflict between the Pharmacy Council of India and AICTE over who had authority to approve such increases. The Supreme Court partially allowed the appeal, directing that students admitted up to 240 total capacity during pending proceedings receive recognition and registration. However, students admitted beyond permitted capacity for 2019-20 were denied such benefits. The Court left the fundamental question of regulatory primacy open for decision in other proceedings.
