Pinku etc vs State of Uttar Pradesh

Bench: 2 — Kurian

In Brief

Three appellants convicted in a criminal case and in custody since 2005 had filed bail suspension applications that were rejected by the High Court. Their appeals have remained pending before the High Court since 2007. The Supreme Court held that appellants should be released on bail during the pendency of such protracted proceedings. The Court allowed the appeals and directed release on bail subject to strict conditions imposed by the trial court, unless the appellants faced charges in unrelated cases warranting continued detention.
