In Brief
Two accused persons, Pooranlal and Gaya Prasad, challenged their conviction for culpable homicide not amounting to murder (Section 304 Part II IPC) after the High Court reversed their acquittal in an appeal by the State. The appellants were among five initially acquitted by the trial court. The Supreme Court upheld the High Court's conviction, finding that while the appellants intended only to teach the deceased a lesson (due to prior insult in a panchayat matter), their unlawful acts caused his death. The court found their case factually distinct and separable from the other three accused. Since no medical evidence showed injuries were sufficient to cause death and the victim survived 14 days, conviction for culpable homicide rather than murder was justified. The appeal was dismissed and the conviction upheld."
