The Commissioner of Income Tax appealed the High Court's dismissal of a tax appeal against A.A. Estate Pvt. Ltd. The Supreme Court found that the High Court failed to comply with statutory requirements: it did not properly frame substantial questions of law as mandated under the Income Tax Act. Instead, the High Court merely noted questions urged by the appellant without itself formally framing them for adjudication. The Court held that a distinction exists between questions proposed by the appellant and those formally framed by the Court. Accordingly, the Supreme Court allowed the appeal and remanded the matter to the High Court to properly frame questions of law and rehear the appeal.
