PRABHJOT KAUR vs STATE OF PUNJAB AND ORS

Bench: 2 — Sudhanshu Dhulia, K. Vinod Chandran

In Brief

The case concerns gender-based reservation in government jobs. Prabhjot Kaur applied for a Deputy Superintendent of Police (DSP) post reserved for Scheduled Caste women under Punjab's 2020 reservation rules. A private respondent challenged this reservation, arguing that a later-issued roster system negated the women's reservation. The Supreme Court held that once an advertisement sets eligibility criteria, these cannot be changed mid-recruitment. Since the roster was issued after the application deadline, it could not apply retrospectively. The Court upheld the appellant's right to the DSP position as the sole qualified woman in her category.
