The Supreme Court found that the High Court's conclusions were not supported by documentary evidence on record. The Court held that a mere report from an Advocate-Commissioner indicating unauthorised construction was insufficient to justify eviction without substantiation by credible documents. The High Court order was set aside, and the case was remitted to the Municipal Corporation to proceed according to law if it deemed fit.
