Pravat Chandra Mohanty vs State of Odisha & Anr

Bench: 2 — Ashok Bhushan

In Brief

Two police officers at Purighat Police Station were convicted for brutally assaulting a man (Kasinath Naik) in custody, resulting in his death. The Supreme Court affirmed convictions under Sections 324 and 471 IPC but rejected a plea to compound the non-compoundable offence under Section 324, holding that custodial violence by police is of grave public concern. However, the Court reduced the sentence from one year to six months considering the appellants' advanced age (75+), while enhancing compensation to legal heirs from Rs. 3 lakhs to Rs. 6.5 lakhs.
