Prem Chand was convicted of rash and negligent driving and voluntarily causing hurt under the Indian Penal Code. While the High Court had confirmed his conviction and modified his sentences to run concurrently, the Supreme Court found that as a first-time offender with no criminal history and good behaviour during proceedings, he deserved the benefit of probation rather than imprisonment. The Court upheld the conviction but set aside the imprisonment sentences, directing the trial court to instead consider probation under Section 360 of the Criminal Procedure Code, 1973."
