Prem Giri vs State of Rajasthan

Bench: 2 — Abhay Manohar Sapre

In Brief

An appellant sought anticipatory bail under Section 438 of the Criminal Procedure Code in connection with alleged offences under the IPC. The High Court dismissed his application without providing reasons. The Supreme Court remanded the case, noting the lack of reasoned findings. The High Court again dismissed the application with the same defect. The Supreme Court held that a bail order must contain reasoned findings addressing the facts and circumstances. When a case is remanded to cure procedural defects, the remanded order must do so; repeating the same error requires another remand. The Court allowed the appeal and remanded the matter to the High Court to decide the application afresh with proper reasons in accordance with law."
