Prem Singh Gill vs Union of India and Ors

Bench: 2 — Kurian

In Brief

Prem Singh Gill, a disabled person, appealed for an increase in his disability rating. The Supreme Court, hearing the appellant in person and considering the background of his disability, invoked Article 142 of the Constitution to do complete justice. The Court fixed the disability rating at 75% with retrospective effect from the date of retirement. Consequential benefits were to be computed accordingly, with arrears to be paid within two weeks, carrying interest at the rate earlier fixed by the Tribunal. The appeal was disposed of without orders as to costs.
