In Brief
Tarsem Singh, a soldier, sustained a jaw injury during a basketball match in 1965 while serving in the Indian Army and was medically boarded out in 1969. Though his initial disability pension claim was rejected, he filed a writ petition in 1997 (after 28 years), which the High Court allowed, granting disability pension arrears from discharge. The Supreme Court upheld this decision, holding that laches and delay cannot defeat a legitimate claim by a soldier injured in service, and that arrears already received should not be recovered. Appeal dismissed."
