Supreme Court of India 2016-12-09 dismissed

President, Vidya Prasarak Samithi, Ramdurg vs Deputy Commissioner, Belgaum District & Ors

Bench: 2 — Pinaki Chandra Ghose

In Brief

Two educational trusts competed for a Government playground in Ramdurg. The appellant Vidya Prasarak Samithi sought exclusive use; Basaveshwar Vidya Vardhak Sangha (BVVS) opposed the grant. The Supreme Court upheld the High Court's Division Bench decision that BVVS had acquired valid ownership of the property through Government transfer after paying the market value fixed by the Public Works Department. Once ownership vested in BVVS, the land was no longer available as Government property to be granted to another institution. The Court held that the grant orders were illegal and invalid, and dismissed the appellant's appeal.
