Priya B.M vs Kerala Public Service Commission and Ors

Bench: 2 — Kurian

In Brief

The appellant was an applicant for a public service position and appeared on a rank list from June 2011. Although she was not a party to an earlier Supreme Court case (Swapna Sukumar) where relief was granted to similarly situated candidates, the High Court declined her relief, limiting it only to the original parties. The Supreme Court held that the appellant, being on the same rank list as candidates already granted relief, was entitled to the same treatment. The Court restored her position in the rank list and directed her appointment within two months, following the principle of equal treatment for similarly situated candidates on the same rank list.
