Priya B.M vs Kerala Public Service Commission and Ors

Bench: 2 — Kurian

In Brief

The appellant, ranked 23rd in a public service commission rank list dated 14 June 2011, challenged the High Court's refusal to grant her the same relief that was awarded to similarly situated candidates in an earlier Supreme Court judgment (Swapna Sukumar case). The High Court had declined relief on the ground that the earlier order was limited to the named parties. The Supreme Court allowed the appeal, holding that the appellant was entitled to identical relief as a similarly situated candidate from the same rank list. The Court set aside the High Court and Tribunal decisions and restored the rank list, directing the respondents to issue an appointment order within two months.
